Trial rescheduled for former media strategist

The trial for the former president of a local media firm has been rescheduled in Delaware County Common Pleas Court for early next month.

Nicholas Everhart, 35, of Columbus, was scheduled to stand trial Tuesday but Everhart’s attorney, Anthony M. Heald, filed a motion to continue the trial for another month. The trial has been rescheduled for July 9 in Judge David Gormley’s court.

Everhart served as the president of The Strategy Group Company, media firm that has reportedly consulted on campaigns for various Republican candidates, until he was reportedly fired in April 2013.

Everhart was indicted by a Delaware County grand jury on Oct. 17, 2014, on two counts of unauthorized use of cable or telecommunications property, fifth-degree felonies.

In a bill of particulars filed by the Delaware County Prosecutor’s Office, which was appointed to this case, prosecutors say that on April 2, 2013, Everhart directed an employee of The Strategy Group, Mitchell C. Marczewski Jr., to gain access to a computer belonging to Strategy Group CEO Rex Elsass and to find any information that might nullify Everhart’s non-compete contract.

The document also alleges Everhart instructed Marczewski to access Elsass’ computer again on April 7, 2013, to retrieve phone numbers, contacts and other files. The files were reportedly given to Everhart after they were downloaded.

Prosecutors say the trial would likely last one to two days.

No charges have been filed against Marczewski.
