Men indicted in 2012 murder

Two Columbus men have been indicted by a Delaware County grand jury on murder charges in connection with a 2012 shooting of another Columbus man along Red Bank Road in Harlem Township.

Dontee Gervins, 29, of Columbus, died several days after he was shot and was “banging” on the door of a township resident, seeking help, authorities said.

A Delaware County grand jury returned a six-count secret indictment Friday against Jermaine Kelly, 31, and Reginald Conley, 27, charging both Columbus men with two counts of murder, and one charge of intimidation of an attorney, victim or witness in a criminal case, a third-degree felony.

Prosecutors report that the shooting occurred on Nov. 9, 2012, and was reported by a 911 caller.

“A Galena resident contacted authorities reporting that an unknown male was banging on her door, shouting he needed help as a result of being shot,” said Delaware County Prosecutor Carol O’Brien. “The man, identified as 29-­year­‐old Dontee Gervins of Columbus, was transported to Riverside Hospital where he died on Nov. 18 as a result of his injuries.”

Kelly is also charged with two counts of having weapons while under disability, which are third-degree felonies, and Conley also faces one charge of having weapons while under disability, a third-degree felony.

Both murder charges carry firearm specifications and gang specifications, both of which could add years to any potential prison term.

Conley was charged with murder in Delaware Municipal Court soon after Gervins’ death in 2012 but the case was dismissed 10 days later while an investigation continued.

Prosecutors report that Conley is in prison on an unrelated conviction and Kelly was taken into custody Friday morning without incident by U.S. marshals. Prosecutors said the Delaware County Sheriff’s Office and the Columbus Division of Police also assisted in the arrest.

Kelly was in the Delaware County Jail Friday afternoon.

Arraignments in Delaware County Common Pleas Court have not been scheduled.

Delaware County Common Pleas Court Judge Everett Krueger will preside over the case.

According to the Ohio Revised Code, penalties for murder include between 15 years and life in prison.
