Lewis Center man’s child porn trial delayed

The trial for a Lewis Center man facing 82 charges involving child pornography has been delayed to Oct. 31.

Dr. David Thomas Ryan, 56, of 3725 Wood Stone Drive, Lewis Center, was scheduled to stand trial Tuesday in Delaware County Common Please Court to face 38 counts of pandering sexually oriented matter involving a minor, second-degree felonies, and 44 counts of pandering obscenity involving a minor, second-degree felonies.

However, on Monday, Assistant County Prosecutor Mark Sleeper filed a motion asking for a continuance. In his motion, Sleeper said the prosecutor’s office has reached out to AOL in order to secure an expert to testify about internet records in the case, but the prosecutor’s office has not heard any reply from AOL. Sleeper added that another witness is ill would be unable to testify.

Delaware County Common Pleas Judge Everett Krueger granted the motion on Tuesday and rescheduled the trial for Oct. 31.

Ryan pleaded not guilty to the charges at an arraignment on Feb. 3 and was originally scheduled to stand trial in May but the trial was delayed to Aug. 22.

At the arraignment, Krueger set Ryan’s bond at $75,000 and according court documents, Ryan posted bail on Feb. 3 and was released from the Delaware County Jail.

According to the indictment, the pandering obscenity involving a minor charges state that Ryan “with knowledge of the character of the material or performance involved, did create, reproduce or publish any obscene material that has a minor as one of its participants or portrayed observers.”

According to the indictment, the pandering sexually oriented matter involving a minor charges state that Ryan “with knowledge of the character of the material or performance involve did create, record, photograph, film, develop, reproduce, or publish any material that shows a minor participating or engaging in sexual activity, masturbation, or bestiality.”

Each count stipulates a different file that Ryan possessed that qualifies as either sexually-oriented matter or obscenity.

The Delaware County prosecutor’s office reports the indictment came after it was reported that an individual had email transactions known to contain child pornography. The Delaware County Sheriff’s Office, along with the Franklin County Internet Crimes Against Children Task Force, investigated the downloading and file sharing of child pornography.

“It took several agencies working together to ultimately track down Dr. David Ryan,” Delaware County Prosecutor Carol O’Brien said in a release after Ryan’s indictment on Feb. 2. “The result was a search warrant being issued on Dr. Ryan’s home, in Orange Township, and ultimately, his arrest.”

Several electronic items were seized in a search warrant executed at Dr. Ryan’s home. Another search warrant was obtained for an additional electronic item, which was seized at his business, Columbus Chiropractic Center.

According to the Ohio Revised Code, penalties for the charges include between two to eight years in prison and fines of not more than $15,000.
