The Affordable Care Act is the law of the land, and while the Delaware County commissioners may not embrace it, they are in compliance with it.

The Delaware County commissioners on Thursday unanimously passed a resolution to address employee health plan eligibility under the Affordable Care Act.

“I don’t think it’s good policy,” said Delaware County Commissioner Gary Merrell. “But I do understand we need to follow the law.”

Under the policy, employees that work at least 30-hour per week will be eligible for full-time employee health care coverage.

But given the tweaks in the law, Delaware County Assistant Administrator Dawn Huston expects more changes on the horizon.

“Obviously the ACA has changed many times, and I anticipate more changes before the end of the year,” she said. “As those happen we will bring this policy back for an update.”

The commissioners also approved another measure that allows current employees working at least 21 hours a week to obtain health insurance by paying 50 percent of the county’s premium share. It is a continuation of a policy adopted in 2011.

The measure affects just eight employees.

“If the eight employees separate from employment for any reason, this exemption ceases even if they become re-employed with Delaware County at a later date,” Huston said.

The policy was approved in a 2-1 vote.

Merrell voted against the measure, saying he has concerns about the cost.

“It’s very expensive to the county,” he said.

Delaware County Commissioner Dennis Stapleton disputed that notion, telling Merrell the policy costs about $100,000.

“It isn’t all that expensive,” he said. “It’s not bad business and it’s good for our folks that have been covered under this.”
