Delaware man indicted for intimidating victim

A Delaware man was indicted Friday after he violated a protection order in June and attempted to intimidate a woman into not testifying against him in Delaware Municipal Court.

A Delaware County grand jury returned an indictment Friday charging Gary Allen Payne, 55, of 181 Park Ave., Apt. 1, Delaware, on two felony counts of violating a protection order; menacing by stalking, a fourth-degree felony; and intimidation of attorney, victim or witness in a criminal case, a third-degree felony.

Police report that on June 1 Payne came to the Wootring Street home of a woman who had a protection order against him. Police learned this was not the first time he had violated the protection order against her.

Police were contacted again on June 16 when the woman said Payne had called her numerous times, disguising his number as a private number. When she stopped answering, Payne continued to call and left 17 messages on her answering machine between 3 p.m. June 15 and 6 p.m. June 16.

A warrant was later issued for Payne’s arrest and he was taken into custody on Sept. 1.

Court documents say that between June 17 and Sept. 1, Payne threatened her if she testified against him.

An arraignment in Delaware County Common Pleas Court has not been scheduled.
