Trial set for both cemetery owners

An August trial has been set for the man who co-owns Fairview Memorial Park.

Theodore L. Martin has been scheduled to stand trial on Aug. 8 in Delaware County Common Pleas Court, along with his wife Arminda K. Martin where each will face a charge of engaging in a pattern of corrupt activity and more than three dozen charges of theft.

The Martins are owners of Fairview Memorial Park and prosecutors allege the Martins have taken money for items and services, but never delivered and have gamble the money away on many occasions.

Both were in federal prison Wednesday, serving a sentence for federal tax evasion.

A hearing will be held on Friday at 2 p.m. to discuss the cemetery after prosecutors asked a judge to appoint someone to take care of it while the cemetery’s affairs are resolved.

Prosecutors have said the trial would likely take four to five days.
