Felonious assault and kidnapping trial delayed

The trial for a Delaware man charged with felonious assault and kidnapping has been moved to July in Delaware County Common Pleas Court.

Roger Allen Madison, 48, of 33 Greenhedge Circle, entered a not guilty plea to a count of felonious assault, a second-degree felony; two counts of kidnapping, first-degree felonies; domestic violence, a first-degree misdemeanor and aggravated menacing, a first-degree misdemeanor; at an arraignment on Feb. 15, and was scheduled to stand trial on Tuesday.

However, on May 26 Madison’s attorney, Todd Workman, asked for a continuance after a key defense witness was hospitalized and would not be able to testify. The trial was then delayed to July 6.

The trial is estimated to take two days.

At the arraignment, Delaware County Common Pleas Court Judge David Gormley told Madison that for the kidnapping charges he could be sentenced to up to 11 years in prison; and could face another eight years for the felonious assault charge.

Delaware police report that during the early morning hours of Feb. 5, 2017, an officer was flagged down by a woman in the area of North Houk Road and West Central Avenue.

The woman needed medical attention and told police that her boyfriend, Madison, forced her to stay in her room at the Greenhedge Circle Home. The woman said Madison threatened to cut her into pieces and throw her into the pond and blocked the door when she tried to leave.

The victim reported that at one point, Madison pushed her to the ground and choked her to the point that she passed out. The victim said she was held for three hours.

Madison was arrested after the investigation and taken to the Delaware County Jail, where he is currently incarcerated.

Madison appeared in Delaware Municipal Court on Feb. 6 and his bail was set at $150,000. The municipal court case was dismissed by prosecutors after the grand jury returned the felony indictment.

At the arraignment in common pleas court, Gormley decreased Madison’s bond to $75,000.
