A Delaware County Grand Jury returned a 13-count indictment against a 31-year-old Delaware woman for allegedly stealing credit cards and other items.

Mallory K. Burns, of 52 Columbus Avenue, Delaware, was indicted Friday and charged with three counts of identity fraud, two third-degree felonies and one fourth-degree felony; six counts of theft, fifth-degree felonies; three counts of receiving stolen property, fifth-degree felonies; and one count of forgery, a fifth-degree felony.

Prosecutors allege that while Burns was working as a home healthcare worker she stole items such as credit cards, cash, and earrings from clients from May 2016 through May 2017.

“Law enforcement responded after the daughter of one of Burns’ elderly clients reported her mother’s credit card was missing,” said Delaware County Prosecutor Carol O’Brien. “Further investigation revealed several unauthorized charges that led to Mallory Burns.”

Five victims are named in the indictment.

An arraignment date for Burns has not been scheduled yet, but the case will be presided over by Delaware County Common Pleas Court Judge David Gormley.

According to the Ohio Revised Code, if Burns is convicted on the charges, she faces a fine or a term of incarceration of up to 36 months in prison for the third-degree felony identity fraud charges; up to 18 months in prison for each of the fourth-degree felony charges; and up to a year in prison for each of the fifth-degree felony charges.

Prosecutors have asked the clerk of courts of issue Burns a summons to appear for her arraignment. Burns has not been arrested.
