A California man charged with two counts of gross sexual imposition was arraigned in Delaware County Common Pleas Court Friday after he was indicted in January.

John J. Stueve, 38, of Imperial Beach, California, entered a not guilty plea to two counts of gross sexual imposition, fourth-degree felonies, at his arraignment Friday morning in Delaware County Common Pleas Court.

Delaware Police report that on Oct. 4, 2014, a 17-year-old girl came to the police department lobby to report she had been touched inappropriately by Stueve on multiple occasions between 2009 and 2014. An investigation was started and on Jan. 29, 2016, Stueve was indicted by a Delaware County Grand Jury for the two charges.

After his indictment, an arraignment was scheduled for March 21 at 2 p.m. and a summons for him to appear was sent to the San Diego County Sheriff’s Office.

The San Diego County Sheriff’s Office reported in February that they were unable to find Stueve at his last known address and he could not be found.

He did not appear at his March arraignment and a warrant for his arrest was issued, court documents indicate.

Stueve was eventually located by authorities on Oct. 12 and was taken into custody. He was brought to Delaware on Oct. 26 and is currently in the Delaware County Jail.

At the hearing, Gormley scheduled a trial for Dec. 20 and set Stueve’s bond at $20,000. A pretrial hearing was also scheduled for Nov. 28 at 10:45 a.m.

Assistant Delaware County Prosecutor, Andrew Bigler, said that Stueve lived in Delaware at the time and was now a flight risk because he has no ties to Delaware. Bigler also estimated that the trial would take two days.

Stueve’s attorney, Michael Lerner, said Stueve told him he did not have a criminal record.

Gormley told Stueve that the potential penalties for a fourth-degree felony are between six to 18 months in prison and a fine of not more than $5,000.

Stueve was in the Delaware County Jail Friday afternoon.
