Both owners of Fairview Memorial Park have pleaded guilty to theft charges in Delaware County Common Pleas Court and will be sentenced in December.

Theodore Martin appeared in court Monday afternoon and pleaded guilty to 14 theft charges, one third-degree felony, eight fourth-degree felonies, and five fifth-degree felonies. At the hearing, Martin said that on numerous occasions he received money from customers for items like grave markers or vaults and would place an order for the items with the manufacturer, but never delivered the items to customers.

Delaware County Common Pleas Judge Everett Krueger asked if Martin placed the money in a trust or if he spent it on personal affairs. Martin said he “probably used a portion” of the money on personal things. As a condition of the plea agreement, the remaining charges against Martin, including one count of engaging in a pattern of corrupt activity, a first-degree felony, and 63 theft charges, were dismissed.

Krueger ordered that Martin undergo a pre-sentence investigation and scheduled a sentencing hearing for Dec. 8 at 2 p.m.

Arminda Martin entered a nearly identical plea on Friday and admitted to taking money for items at Fairview, such as grave markers or plots, but never delivering the items or putting the money in a trust.

Assistant Prosecutor Cory Goe told the court on Friday that Arminda and Theodore Martin frequently withdrew the money and gambled with it at a casino in Pennsylvania.

Arminda Martin pleaded guilty to 15 counts of theft, one third-degree felony, eight fourth-degree felonies, and six fifth-degree felonies at the change of plea hearing on Friday. The remaining charges, including one count of engaging in a pattern of corrupt activity, a first-degree felony, and 43 theft charges, were dismissed.

Arminda is also scheduled to be sentenced on Dec. 8 at 2 p.m.

A condition of both pleas is that the Martins pay restitution to all the victims, including the victims in the dismissed charges. The amount of restitution has not yet been calculated.

Arminda Martin was free on bond Monday. After his change of plea, arrangements were being made to transfer Theodore Martin back to the Federal Correctional Institution in Lisbon, Ohio.
