Delaware woman found guilty of vehicular assault

A Delaware woman was found guilty of aggravated vehicular assault and OVI after a bench trial in Delaware County Common Pleas Court earlier this week.

Misty Moore, 38, of 239 Niatross Place, Delaware, was found guilty of two felony counts of aggravated vehicular as well as a charge of operating a vehicle under the influence of alcohol or drugs, a first-degree misdemeanor, after a one-day bench trial in Delaware County Common Pleas Court.

Visiting Judge Timothy Campbell presided over the case and scheduled a sentencing hearing for May 16.

Court documents say that Moore was indicted on April 17, 2015. She was also charged with an additional count of OVI but she was acquitted of that charge Thursday.

The charges stemmed from a Feb. 4, 2015, crash.

“The incident happened just before 7 a.m. on Hyatts Road in Liberty Township,” said Delaware County Prosecutor Carol O’Brien. “On-scene law enforcement smelled alcohol and observed Ms. Moore appeared disoriented and had slurred speech.”

Prosecutors said two other vehicles were involved in the crash. The drivers of the other vehicles reportedly sustained injuries that included back and neck pain, a broken toe and a fractured vertebrae.
