A Delaware man was sentenced to 50 years to life in prison Wednesday after a jury found him guilty of two counts of rape last week.

Shawn Michael Miller, 46, appeared in Delaware County Common Pleas Court to be sentenced for two counts of rape, first-degree felonies. A jury found Miller guilty of the two charges on July 18 after a five-day trial.

During the trial, prosecutors alleged that Miller raped a 12-year-old girl twice on May 1, 2016, while the girl was living with Miller.

Prosecutors took Miller to trial in January and April of this year, where a jury found Miller not guilty of several other charges, including gross sexual imposition and endangering children, but both previous juries were hung on the two rape charges and could not make a decision.

The two rape charges carry a specification that Miller purposely compelled the girl to submit by force or threat of force, which automatically increases the mandatory minimum sentence to 25 years to life in prison for each charge.

The victim did not speak at the sentencing hearing, but Assistant County Prosecutor Douglas Dumolt spoke on her behalf and told Delaware County Common Pleas Judge David Gormley that the girl had suffered serious psychological harm as the result of the incident.

“This will be with her for the rest of her life,” Dumolt said.

Dumolt asked Gormley to give Miller consecutive sentences and said that only Gormley had the power to make sure Miller could never hurt other children again.

Gormley sentenced Miller to 25 years to life in prison for both of the rape charges and ordered that the sentences be served consecutively for a total sentence of 50 years to life in prison.

Gormley credited Miller the 333 days he spent in the Delaware County Jail and said that if he is released from prison he must register as a Tier III sex offender.

Miller’s defense attorney, Brian G. Jones, asked Gormley to appoint someone from the Ohio Public Defender’s Office to represent Miller during the appeals process.

Miller was in the Delaware County Jail Wednesday, awaiting transport to prison.

“While we are pleased with the jury’s hard work and just verdict, no sentence can ever bring closure to this young lady and her family,” said Delaware County First Assistant Prosecutor Kyle Rohrer in a statement Wednesday.
